All services provided by Strand Davis Enterprises ("Strand Davis Enterprises") may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any United States federal, state or city law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless Strand Davis Enterprises from any claims resulting from the use of service which damages the subscriber or any other party.

REFUSAL OF SERVICE:  We reserve the right to refuse, cancel or suspend service, at our sole discretion.

MONEY BACK GUARANTEE AND REFUND POLICY:  All work shall be undertaken only after both the customer and Strand Davis Enterprises have discussed and agreed upon the project and the terms that must be met in order for the project to be considered satisfactorily completed.  If Strand Davis Enterprises misses the agreed upon deadline by more than 48 hours, customer shall receive a 25% refund.  Customer shall receive a 50% refund if the deadline is missed by 7 days, and a 100% refund if the deadline exceeds 10 days overdue.

If Strand Davis Enterprises  cancels  service after money has been paid due to no fault of the customer, the customer shall receive a full refund. 

LIMITATION OF LIABILITY:  To the maximum extent permitted by applicable law, in no event will Strand Davis Enterprises be liable for any special, incidental, indirect, exemplary or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss or damage) arising out of the use of products commissioned by and created for the customer.

In any case, Strand Davis Enterprises's maximum cumulative liability and your exclusive remedy for any claims arising out of or related to this Agreement will be limited to the amount actually paid by the customer for the Service (if any) in the previous twelve (12) months. Because some states and jurisdictions do not allow the exclusion or limitation of liability, the above limitation may not apply to You.

INDEMNITY:  You agree to indemnify and hold Strand Davis Enterprises, its officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers and employees, harmless from any claim or demand, including reasonable attorney fees and court costs, made by any third party due to or arising out of projects completed and delivered to you, the customer, available through the Service, your use of the Service, your violation of the TOS, your breach of any of the representations and warranties herein, or your violation of any rights of another.

The TOS constitute the entire agreement between you and Strand Davis Enterprises and govern your use of the Service, superceding any prior agreements between you and Strand Davis Enterprises. The TOS and the relationship between you and Strand Davis Enterprises shall be governed by the laws of the State of Iowa without regard to its conflict of law provisions. You and Strand Davis Enterprises agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Johnson, Iowa. The failure of Strand Davis Enterprises to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. If any provision of the TOS is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the TOS remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the TOS must be filed within one (1) year after such claim or cause of action arose or be forever barred.

If you provide this information, Instant Health Insurance will only use it for our own information. We will not sell or otherwise divulge the information to 3rd parties.
